Certainly there is a line somewhere between imitation and actually ripping off someone else's video game, which is a real and regular problem. I would be interested in learning where the average gamer and dev thinks that line should be.

Imitation is the most sincere form of flattery. If they tried to adapt the best parts from Fallout into their own game, then good for them. Not liking this game because it "ripped off" elements of the Fallout franchise is akin to not liking over %90 of today's music on the premise it "stole"...
